1. Scope

These General Terms and Conditions apply to the use of all Cosmos Arcade locations as well as to the use of all services provided by Cosmos Arcade HMH GmbH. By entering a Cosmos Arcade branch or purchasing a Playcard, you accept these GTC.

2. Playcard & Credits

The Cosmos Arcade Playcard is a rechargeable payment method that can only be used at our locations.

• Credits never expire. Once credited, credits remain valid indefinitely.
• The Playcard is non-transferable and non-refundable.
• In case of loss or theft of the Playcard, there is no claim for reimbursement of the balance unless proof of the remaining balance can be provided.
• The purchase of a Playcard is possible by cash, EC card, or credit card.
• The Playcard can be redeemed at all Cosmos Arcade locations.
• A conversion of credits into cash is excluded.

3. House Rules

The respective house rules apply to all Cosmos Arcade locations. In particular:

• Instructions from staff must be followed.
• The gaming machines must be treated with care. In case of intentional damage, the perpetrator is liable.
• Bringing food and drinks is not permitted unless otherwise indicated.
• Smoking is prohibited in all indoor areas.
• Persons under the influence of alcohol or drugs may be expelled by the operator of the venue.
• Cosmos Arcade reserves the right of admission and may impose a ban from the premises in case of violations of the house rules.

4. Liability

Cosmos Arcade HMH GmbH is liable within the framework of legal provisions. Liability for slight negligence is excluded unless essential contractual obligations (cardinal obligations), damages resulting from injury to life, body, or health, or guarantees are affected.

• The use of gaming machines is at your own risk.
• No liability is accepted for the loss or theft of personal belongings.
• Parents or guardians are liable for their children.

5. Youth Protection

Cosmos Arcade complies with the provisions of the Youth Protection Act (JuSchG).

• Children under 14 years of age may only visit our locations when accompanied by a person with parental authority.
• Young people under 16 years of age may stay in our premises until 10:00 PM, and those under 18 years of age until midnight (each without accompaniment).
• Age checks may be conducted at events with age restrictions (e.g., bachelor parties from 18).
• Alcoholic beverages are only served to persons aged 18 and over.

6. Events & Bookings

• Event bookings (children's birthdays, corporate events, bachelor parties, etc.) are binding upon written confirmation by Cosmos Arcade.
• Cancellations are free of charge up to 7 days before the event. For later cancellations, a cancellation fee of up to 50% of the booking price may be charged.
• Cosmos Arcade reserves the right to cancel or postpone events due to force majeure or unforeseen circumstances.
• The stated package prices include the statutory value-added tax.
• Special agreements require written form.

8. Severability Clause

Should individual provisions of these terms and conditions be or become ineffective, the effectiveness of the remaining provisions shall not be affected. Instead of the ineffective provision, an effective provision shall apply that comes closest to the economic purpose of the ineffective provision.

9. Applicable Law & Jurisdiction

The law of the Federal Republic of Germany applies. The place of jurisdiction is Hamburg, provided the customer is a merchant, a legal entity under public law, or a special fund under public law.
